Virginia Prosecutors See Insufficient Evidence to Charge NY Attorney General Letitia James in Mortgage Fraud Case

Prosecutors of the Virginia Department of Justice believe that there is currently not enough evidence to bring charges against Letitia James, the New York Attorney General, and her role in the mortgage fraud case, according to informed sources.

Five months of investigation have included dozens of witness interviews, but according to people close to the case, the investigation is ongoing.

The U.S. Attorney’s Office for the Eastern District of Virginia declined to comment on details of the case.

In the context of discussions about cases involving James, there was also talk of possible activity by the Department of Justice during her taking office, though no specific conclusions were publicly announced. According to several people familiar with the matter, such discussions could influence the overall assessment of the case.

In short: early reporting underscores that the James cases remain open, and the investigation continues.

If James were to be charged, it would be a significant escalation by the DOJ in its obligation to pursue people who investigated Trump during his two terms in office. James won a civil case against the Trump Organization and the president himself over allegedly dubious business practices. The New York Court of Appeals affirmed the finding of fraud but vacated the nearly $500 million penalty, calling it too large. The decision is currently being appealed.

Since May, prosecutors have been investigating whether James knowingly provided false information on a credit application, stating that a property in Virginia is her primary residence.

Nevertheless, documents provided by James’s lawyers to the DOJ and reviewed by investigators sometimes point to a different picture: in some materials James stated the opposite. In one letter to a mortgage broker, James wrote: “this property will NEVER be my primary residence”.

Nevertheless, the U.S. Attorney for the Eastern District of Virginia is under pressure from Ed Martin, head of the Working Group on the Use of Law Enforcement Powers, and Bill Pulte, the director of the Federal Housing Finance Agency, according to two informed people.

Martin and Pulte also leveled accusations against Democratic Senator Adam Schiff and Federal Reserve Governor Lisa Cook; both rejected these claims.

Martin did not respond to a request for comment.

Also, it is known that in Albany, New York, a separate grand jury is considering charges against James; the investigation concerns possible civil rights violations related to actions against Trump, according to informed sources.

Additionally, Martin is overseeing an investigation into James’s property in New York: he personally visited the site last month and posed by it.
